Con solo ocho días antes de las elecciones del 3 de noviembre, la Corte Suprema se enfrenta a muchos nuevos problemas y posibles cambios en las decisiones de la Corte Suprema de larga data. En detrimento de la nación, la juez Ruth Bader Ginsburg ha fallecido. No solo nos ha afectado su muerte por la cantidad de icono que era, sino también por el papel que desempeñó en la Corte Suprema. Hasta su muerte, hubo una mayoría conservadora de 5-4 en la Corte Suprema, ahora con la posible adición de una nueva justicia conservadora, habrá una mayoría de 6-3, que puede alterar las futuras decisiones tomadas por esta corte.
¿Quién es la nueva justicia que tendría que llenar los zapatos grandes de RBG, puede preguntar? Amy Coney Barrett es otra juez de circuito y ex profesora de la Escuela de Derecho de Notre Dame. Barrett tiene todas las calificaciones de ser una justicia, sin embargo, porque el presidente Trump pudo nominar a ella, ella es sin duda una conservadora. Su postura sobre varios temas está en total oposición a su predecesor, Juez Ginsburg. Los liberales y los conservadores esperan que ella permita desmantelar Roe v Wade y tal vez lleve a la destrucción del legado de Ginsburg.
Antes de profundizar, vamos a ver un rápido resumen de lo que es Roe v Wade. Wade fue una decisión histórica de 1971 - 1973 por la Corte Suprema de Estados Unidos. El tribunal dictaminó que una ley estatal que prohibía los abortos (excepto para salvar la vida de la madre) era inconstitucional. La sentencia hizo legal el aborto en muchas circunstancias. La decisión muy controvertida del tribunal enfureció a los religiosos estadounidenses, así como a muchos republicanos. Ahora con la nominación de la sexta justicia católica, es más que probable que esta decisión sea anulada o seriamente restringida. Barrett dijo. “ Creo que la pregunta de si las personas pueden tener abortos muy tardíos, cuántas restricciones pueden ser puestas en clínicas, creo que eso cambiaría”.
Sin embargo, lo que se sabe es que si se hace jurar en las raíces de las decisiones cruciales tomadas por el tribunal será inherentemente más conservadora. ¿Cómo actuará Barrett como juez del Tribunal Supremo?; todavia no lo sabemos, pero si tiene un buen sentido de los valores de su predecesor, derechos como los que protegen a las mujeres y la igualdad, en general, sobrevivirán al cambio hacia la derecha.
